ANJANA MISHRA ORAL ORDER 09-12-2019 Heard learned Senior Counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Barahara (Sinha O.P.) P.S. Case No. 327/2018 registered for the offence punishable under Sections 147/148/149/448/341/ 323/307/379/354/504/506 of the Indian Penal Code. Learned Senior Counsel for the petitioner submits that two FIRs have been lodged on the same day one by the petitioner's side and the other by the informant's side which have been registered as two consecutive cases. It is submitted that the case registered by the informant is in retaliation of the case registered by the petitioner in which there was a free fight between them and the same has been marked as Annexure-2 to the present application for grant of anticipatory bail. No.76264 of 2019(2) dt.09-12-2019 2/2 submitted that there is case and counter case between the parties with injuries on both sides and the father of the present petitioner Dharmraj Singh was seriously injured and hospitalized on the same date and, therefore, his FIR came to be filed later. Learned Senior Counsel for the petitioner next submits that there was no intention to kill as there was no repetition of blows on either of two who are said to have been injured. Learned Senior Counsel submits that the petitioner has no criminal antecedents.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Barahara (Sinha O.P.) P.S. Case No. 327/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
