Petitioner, already in custody, seeks bail in connection with Marouna P.S. Case No.115 of 2017 registered under Sections 341, 323, 376, 504, 506, 34 of the Indian Penal Code. Allegation in brief is that the petitioner committed rape to the prosecutrix.

Learned counsel for the petitioner submits that the petitioner was an electric mechanic and the informant wanted that electric meter be installed in her home by the petitioner, when he refused then this false case was instituted and no spermatozoa was found as per the medical report; whereas the learned counsel for the State submits that the prosecutrix is a
