02. In the present case, the petitioner seeks bail in connection with Garkha P.S. Case No. 478 of 2024 registered for the alleged offences under Sections 111, 287, 324(5), 61(2) of Bharatiya Nyaya Sanhita, 2023, Section 15(2), 15(4) of The Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962, Section 3⁄4 of the Explosives Act, 1884, Section 3 of the Prevention of Damage to Public Property (PDPP) Act, 1984 and Section 7 of the Essential Commodities Act.
03. As per prosecution case, unknown miscreants tried to tap the gas pipeline of Indane Oil Corporation resulting in a fire incident. The name of the petitioner and other co-accused
Patna High Court CR. MISC. No.66921 of 2025(2) dt.24-09-2025 2/3 persons transpired in this case for making an attempt to commit theft of oil through said gas pipeline.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is no material to show his involvement. The recovery shown from the petitioner appears to be planted and such articles could be found anywhere. The petitioner has been named in this case on the basis of confessional statement made by a co-accused in some other case. The petitioner is having antecedent of three cases. The petitioner is in custody since 31.05.2025 and charge-sheet has been submitted.
05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Saran at Chapra/court concerned in connection with Garkha P.S. Case No. 478 of 2024, subject to the conditions mentioned in
Patna High Court CR. MISC. No.66921 of 2025(2) dt.24-09-2025 3/3 Section 480(3) of BNSS and the following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
