Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)(a)(c), 26, 35 of the Arms Act and Section 27 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Some other named accused persons were arrested from the hotel and firearm as well as Ganja was allegedly recovered from their possession. They have stated that they have come to purchase the firearm from the petitioner. Thereafter, the petitioner was arrested from his house.

Submission is that the arrest cum production memo would reveal that no material was there against the petitioner, save and except, statement of the co-accused. This

Patna High Court Cr.Misc. No.20183 of 2018 (2) dt.13-04-2018 2/2 petitioner has been named in the FIR. Nothing has been recovered from possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chowk Police Station Case No. 28 of 2018 (Special Case No. 08 of 2018), subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
