JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Budha Colony P.S. Case No. 436 of 2018, registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 326, 332, 333, 337, 338, 353, 427, 449, 450, 451, 452, 461, 120 (B) of the Indian Penal Code and Section 3 /4 of Damage to Public Property Act. As per F.I.R. petitioner and several other trainee constables were engaged in arson and other activities in the police line. They have identified in the CCTV footage and made accused in this case.

Submission of the learned counsel for the petitioner is that they have already suffered as they have lost the job and as such petitioner may be released on bail.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Patna, in connection with Budha Colony P.S. Case No.-436 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
