JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Dhoraiya P.S. Case No. 186 of 2017 for the offences punishable under sections 366 and 366 (A) of the I.P.C.
Allegedly, the minor daughter of the informant having love affair with the petitioner went away from the house and it is suspected that the petitioner has kidnapped her with an intention to marry with her.
Submission is of false implication and that the statement of the victim girl recorded under section 164 of the Cr.P.C. has not supported the allegation of kidnapping rather she
Patna High Court Cr.Misc. No.21319 of 2018 (2) dt.27-04-2018 2/2 has stated that she went away with the petitioner with her own consent and as such no offence as alleged is made out, the petitioner has got no criminal antecedent and as such he deserves sympathetic consideration.
The learned A.P.P. submits that the age of the victim girl has been assessed as 17 years.
In the facts and circumstances stated above, considering the statement of the victim girl, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M-IV, Banka in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
