Petitioner, already in custody, seeks bail in connection with Parbatta PS Case No.89 of 2017, registered under Sections 302, 201/34 of the Indian Penal Code.
Allegation in brief is that a dead body was found by the side of the road, later on it revealed that it was the dead body of the driver of a pick-up van, which was looted by the miscreants and recovered from one Bihari Mandal and his wife disclosed that a vehicle was got there by one Akshay Mandal who disclosed the name of the petitioner also as one of the associates in his confessional statement.
Learned counsel for the petitioner submits that except disclosure of name of the petitioner in the confessional statement of Akshay Mandal, there is no other material against him,
Patna High Court Cr.Misc. No.30502 of 2018(2) dt.16-05-2018 2/2 moreover he has no criminal antecedent and seeks bail on the ground of parity as Mithun Mandal and Hare Ram Mandal have been admitted to bail by this Court as well as by another coordinate Bench of this Court vide Cr. Misc. No.1967 of 2018 on 20.02.2018 and Cr. Misc. No.24337 of 2018 on 26.04.2018 respectively.
Having considered the aforesaid facts and circumstances, petitioner Bikash Kumar Tanti @ Biksha Sharma @ Bikash Tanti @ Bikash Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Naugachiya, Bhagalpur in connection with Parbatta P.S. Case No.89 of 2017 with following conditions:
(1) One of the bailors must be the close family member of the petitioner.
(2) The petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled. (Arun Kumar, J) S.KUMAR/- U T
