Versus
The Chairman Bihar State Electricity Board & Ors .... .... Respondent/s =========================================================== Appearance :
For the Appellant :
Mr. Jitendra Prasad Singh, Advocate For the Respondents : Mr. Vijay Kumar Verma, Advocate =========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI and HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) Date: 10-03-2017 There is delay of 36 days in moving the appeal. For the reasons indicated in the limitation petition, the delay is condoned. I.A. No. 9411 of 2013 is allowed.
Heard counsel for the appellant and counsel for the erstwhile Electricity Board.
The learned single Judge has rightly dismissed the writ application of the present appellant, who happens to be the son of the erstwhile employee, who had retired on 31.12.2001 and died in the year 2006 for grant of certain benefit, which is super selection grade. Since the rationale and reasoning provided by the learned single Judge for dismissal of the writ application is not erroneous, no interference is warranted with the order impugned.
Patna High Court LPA No.1704 of 2013 dt.10-03-2017 2/2 Appeal is dismissed.
