The petitioner apprehends his arrest in Punpun P.S. Case No.215 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The police intercepted one motorcyclist, who was carrying bag. On search, 19 bottles each containing 375 ml whisky. The apprehended accused disclosed his name as Santosh Kumar Singh. He also disclosed that Manju Devi, Manoj Singh (father of petitioner) and Guddu Singh are also indulged in illegal trade of liquor. The house of Manju Devi was searched and a huge quantity of liquor was recovered but the house of Manoj Singh (father of petitioner) was not searched and nothing has been recovered from the house of the petitioner. Save and except the disclosure made by Santosh Kumar Singh,
Patna High Court CR. MISC. No.65845 of 2019(2) dt.21-10-2019 2/2 there is no material to show the involvement of this petitioner in illegal trade of illicit liquor.
Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Punpun P.S. Case No.215 of 2019 (Special Case No.7226 of 2019), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Harish/- U
