JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This is an application for grant of anticipatory bail in connection with Keoti P. S. Case No. 200 of 2017 disclosing offences under Sections 420, 406, 467, 468 and 34 of IPC. As per F.I.R. petitioner on assurance double the money has collected the amount from the different persons including the informant and thereafter, after closing the bank, he fled away away. The petitioner happens to be the Chairman of the Co-operative Society.

Submission of the learned counsel for the petitioner is that it is a Co-operative Society and not a Bank, which will appear from Annexure-4 and amount was collected only from the members of Co-operative Society and considering the same one of the accused persons has been granted privilege of bail,

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that the witnesses have supported about depositing the amount with the Cooperative Society of the petitioner. Having heard both sides, considering the above submissions and as the other accused person has been granted privilege of anticipatory bail by a Co-Ordinate Bench of this Court, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M.- VII, Darbhanga, in connection with Keoti P. S. Case No. 200 of 2017 with condition that he has to appear before the I.O. and cooperate in the investigation, otherwise, the prosecution is at liberty to move for cancellation of his bail bonds.
