The petitioner has renewed his prayer for bail in a case under sections 30(a) and (c), 36 and 38 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, on secret information having been received checking was started. Seeing the police vehicle, the accused persons made an attempt to escape but the petitioner was caught. 40 litres of country liquor and 400 litres of spirit was recovered from the vehicle in question. The earlier application for bail of the petitioner was rejected vide order dated 07.06.2022 (Annexure-1) passed in Cr. Misc. no.72211 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner has remained in custody since 19.11.2021.

Having heard learned counsel for the parties and taking into consideration the liberty granted to the petitioner in the earlier order of rejection dated 07.06.2022 and the petitioner having remained in custody for one year, the Court directs the petitioner to be enlarged on bail in connection with Karakat P.S. Case no. 178 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IIcum-Special Judge, Excise, Rohtas at Sasaram.
