Mr. Rajiv Nayan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 04-01-2023 Heard Mr. Pawan Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Rajiv Nayan, learned APP for the State.

A report was called for vide order dated 07.12.2022 and in compliance of the order the Additional District & Sessions Judge-IX, Kaimur at Bhabua has submitted a report that altogether there are fifteen prosecution witnesses out of which only four witnesses have been examined on behalf of the prosecution.

The Superintendent of Police, Kaimur at Bhabua is directed to produce the remaining eleven witnesses on each date fixed by the trial court without fail.

The trial court is directed to conclude the trial expeditiously preferably well within a period of five months.

Patna High Court CR. MISC. No.67308 of 2022(3) dt.04-01-2023 2/2 The Superintendent of Police, Kaimur at Bhabua must produce all the witnesses within the prescribed period or he will be liable to give explanation to this Court as to what led him not to produce the witnesses.
