Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 420, 411 and 414/34 of the Indian Penal Code.

The petitioner is in custody since 16.09.2017 in the matter of an FIR registered against unknown relating to occurrence of theft of motorcycle.

Submission is that name of the petitioner surfaced in the confessional statement of co-accused, namely, Md. Mustakim @ Happa. Thereafter the police apprehended the petitioner because said motorcycle was recovered from the possession of son of the petitioner.

Considering the nature of material and period

Patna High Court Cr.Misc. No.10727 of 2018 (2) dt.27-02-2018 2/2 already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kasba Police Station Case No. 171 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
