Standing Counsel (5) ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 23-10-2024 Heard learned counsel appearing on behalf of the petitioner and the learned SC No.5 for the State.

Leaned counsel appearing on behalf of the petitioner informs this Court that pursuant to the detail application informing that the petitioner has been acquitted from Special Case No.82 of 2002 and Special Case No.103 of 2002, he became entitled for being considered for grant of financial progression, which has not been granted to him by way of the first and the second ACP .

3. Learned counsel submitted that though the

Patna High Court CWJC No.15936 of 2024(3) dt.23-10-2024 2/3 petitioner has filed a written application before the Principal Secretary, Water Resources Department, Government of Bihar (respondent no.2). The case of the petitioner has only been forwarded in the year, 2024 to be considered, which has been reflected from the communication as contained in letter no.497 dated 19.03.2024 and the petitioner is being unnecessarily penalized. Learned counsel, however, submits that the petitioner will pursue the remedy before the Principal Secretary, Water Resources Department, Government of Bihar for considering his case expeditiously in accordance with law.

Considering the aforesaid information and the desire of the petitioner that he will approach the Principal Secretary, Water resources Department, Government of Bihar for consideration of his claim for grant of the first ACP and the second ACP, the present writ petition is disposed of with a direction to the respondent no.2 to redress the grievance of the petitioner in accordance with law laid down by the Apex Court in the case of Amresh Kumar Sinha & Ors. Vs. The State of Bihar & Ors. reported in 2023 SCC OnLine SC 496 after verifying the service records of the petitioner expeditiously without further delay.
