2. The petitioner seeks regular bail in connection with Sessions Trial No. 239 of 2023 arising out of Muzaffarpur Town P.S. Case No. 13 of 2021, lodged on 07.01.2021, under Sections 302 & 394 of the Indian Penal Code and Sections 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the regular bail application of the petitioner was earlier rejected vide order dated 16.08.2023 passed in Cr. Misc. No. 42742 of 2023.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner has been in custody since 03.01.2022, having clean criminal antecedent. Counsel also

Patna High Court CR. MISC. No.71781 of 2024(4) dt.04-07-2025 2/2 submits that the co-accused has already been granted bail by this Court vide order dated 13.07.2022 passed in Cr. Misc. No. 35425 of 2022.

5. Learned APP for the State opposes the prayer for bail and submits that in the earlier order dated 11.10.2022, passed in Cr. Misc. No. 26468 of 2022, it has been acknowledged that one co-accused voluntarily made statement under Section 164 of the Cr.P.C. before the Magistrate stating that it is Kishan Kumar @ Lallu who has given loaded katta to Md. Sonu Alam @ Sonu (the present petitioner) and Md. Sonu Alam @ Sonu (the present petitioner) has fired gun shot in the head of the deceased in his presence.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Accordingly, the bail application of the petitioner is hereby rejected.

7. The Trial Court is hereby directed to expedite the trial.
