JUSTICE ARUN KUMAR ORAL ORDER 23-02-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks bail in connection with Udwant Nagar P. S. Case No. 354 of 2014, registered under Sections 302/34 of the Indian Penal Code. Allegation in brief is that the informant's husband was taken away from the house by his partners, Bipin Singh and Radhamohan Singh @ Munnu Singh but he did not return. The informant saw that two other persons namely, Manoj Singh and Pintu Singh also standing on the road and thereafter, the dead body was found and cause of death is strangulation. Learned counsel for the petit6ioner submits that except the petitioner, standing on road there is no other material against

No.5974 of 2018 (3) dt.23-02-2018 2/2 the petitioner and informant's husband was taken away by two other accused persons namely, Bipin Singh and Radhamohan Singh and similarly situated co-accused, Manoj Singh has been admitted to bail by a Co-ordinate Bench of this Court vide order dated 28.01.2017 passed in Cr. Misc. No. 54691 of 2016. It is further submitted that the petitioner has only one criminal antecedent under the Excise Act except that, there is no other case against him.

Having considered the said facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P. S. Case No. 354 of 2014.
