JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-11-2019 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest for the offences alleged under Sections 304B, 201 and 120B/34 of the Indian Penal Code registered in connection with Laraiyatand P.S. Case No. 03 of 2019.

The prosecution case is that the informant Subodh Prasad Singh submitted his written report before the Station House Officer, Laraiyatand Police Station on 25.01.2019 alleging therein that in the last year he performed the marriage of his niece with Raju Singh as per Hindu custom and rituals. The husband of his niece, his parents and sister always tortured her niece for demand of dowry of Rs. 50,000/- in cash and Honda motorcycle. The father of his niece is handicapped and poor, therefore, he is unable to fulfill the demand of dowry. It is further alleged that on 25.01.2019 in the morning at 9

Patna High Court CR. MISC. No.66210 of 2019(2) dt.15-11-2019 2/2 A.M., he got information that his niece Shweta Devi was killed by setting her on fire. On getting such information, the informant and others went to the house of his niece then the grand-mother and uncle of the husband of his niece asked that the deay body was burnt. On asking, the grand-mother asked that she had no knowledge about Raju Singh, his father and mother. On asking about his sister, she asked that his sister Priyanka Devi also went with them. Learned counsel for the petitioner submits that the petitioner is father-in-law of the deceased and there is no specific allegation against the petitioner, who has no criminal antecedents.

In the facts and circumstances of the case, in case the husband of the deceased, namely, Raju Singh surrenders in the court below within one week and on his surrendering in the court below, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, he shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Mr. Vishwajeet Kumar, learned Judicial Magistrate 1st Class, Munger in connection with Laraiyatand P.S. Case No. 03 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
