2. The petitioner has preferred this application for grant of regular bail in connection with Ganga Bridge P.S. Case No. 40/2025 dated 23.03.2025 registered for the offences punishable u/ss 118(1), 109, 303(2), 352, 351(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and other co-accused persons armed with sickle, sword and iron rod surrounded the informant and abused him and demanded extortion money. When the informant refused, then on the order of the co-accused, Jagarnath Rai, the petitioner assaulted on the head of the informant with sickle due to which he sustained

Then the coaccused, Vikas Kumar assaulted the informant with sword on his back due to which he sustained cut on his back. When the informant's cousin brother came to rescue, the co-accused, Jagarnath Rai assaulted him with iron rod due to which he sustained cut injury on his left hand. Thereafter, they were taken to the hospital for treatment. It is also alleged that the accused persons snatched gold Hanuman Ji locket from the neck of the informant and Rs. 2,000/- from the informant's pocket.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. As per the Injury Report, the informant sustained six injuries out of which there are two incised wounds on his head, out of which the injury no. 2 is on ocipital region 4 and a half inch long, one inch wide and deep with bleeding up to bone-touch. Learned counsel for the petitioner has submitted that nature of injury is not mentioned in the injury report. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 11.04.2025.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.67062 of 2025(2) dt.13-10-2025 3/3 opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 40/2025, with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
