This application has been filed under Section 482 of the Code of Criminal Procedure to quash the order dated 19.010.2013 passed in Criminal Revision No. 537 of 2013 filed by Rabindra Prasad Singh and others against petitioners, whereunder the Sessions Judge, Samastipur dismissed the said Criminal revision preferred against the order dated 07.08.2013 passed in MR No. 234 of 2013 terminating the proceeding under Section 144 Cr.P.C. arriving at conclusion that dispute is related to ownership of land which could be decided by the competent Civil Court.
Perused the impugned order, the learned Sessions Judge has dismissed the Criminal Revision with observation that proceeding under Section 144 Cr.P.C. has lost its force after sixty days without going into merit, I do not find any illegality amounting to abuse of process of Court for interference in extraordinary jurisdiction under
Patna High Court Cr.Misc. No.54365 of 2013 (4) dt.17-07-2017 2/2 Section 482 Cr.P.C. Accordingly, this application is dismissed. (Rajendra Kumar Mishra, J) manish/- U T
