2. The petitioner has preferred this application for grant of regular bail in connection with Gidha P.S. Case No. 81 of 2025 dated 07.04.2025 registered for the offences punishable u/s 96 of the B.N.S.

3. As per the prosecution case, when the informant's sister namely Anjali Kumari had gone to school for taking her T.C. but she did not return back then the informant started to search but he did not find her. It is further alleged that the informant's sister used to talk on mobile with the petitioner and also alleged that the informant's sister used to call 6209490074 and 6207315563 from her mobile number.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.67703 of 2025(2) dt.28-11-2025 2/2 case. As per the impugned order, the victim in her statement recorded u/s 183 of the BNSS, has not made any allegation of sexual assault against the petitioner. It is further submitted that there is nothing on record which shows that the victim was forced to have illicit intercourse with another person. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.07.2025. Similarly situated co-accused has already been granted bail by this court vide order dated 09.07.2025 passed in Cr. Misc. No. 39414 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Gidha P.S. Case No. 81 of 2025.

7. The application stands allowed.
