The petitioner is apprehending his arrest in connection with Kotwali P.S.Case No.126/2019 registered for offences punishable under Section 379 of the Indian Penal Code and later on section 411 of the IPC.
FIR discloses theft of the motorcycle of the informant. It further appears that later on motorcycle was recovered from possession of the petitioner and one co-accused and a case under Section 30(a) of the Bihar Prohibition Excise Act has also been lodged .
Submission of the learned counsel for the petitioner is that he is a student and falsely been implicated in this case and in another case he has been granted bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
With the aforesaid direction, this application is dismissed.
