JUSTICE BIRENDRA KUMAR ORAL ORDER 29-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody in connection with Mithanpura P.S. Case No.381 of 2017, a case under Sections 420/467/468/471/120B/34 of the Indian Penal Code and Sections 14(C)/14(A)(a) of the Foreign Act.
The petitioners were apprehended on suspicion that they are not Indian Nationals and they were found moving in India.
Submission of the learned counsel for the petitioners is that in fact the petitioners are Indians, which would be evident from the AADHAR card and Driving License issued in
Patna High Court Cr.Misc. No.4515 of 2018 (2) dt.29-01-2018 P2/ the name of the petitioners.
A photo copy of the AADHAR card and Driving License have been produced for perusal of the Court. Considering the aforesaid fact, let the petitioners, above named, be released on bail after examining the genuineness of the original documents produced by the petitioners on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mithanpura Police Station Case No. 381 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
