2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 61(2), 103 and 3(5) of the BNS and Section 27 of the Arms Act.
3. The informant has alleged that her husband was working as property dealer and on 18.12.2024, she received an information that her husband has been shot near Kamaldah Pokhar and when she along with other relatives brought him to Sadar Hospital, Buxar for treatment, doctor declared him dead.
4. Learned senior counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the
Patna High Court CR. MISC. No.67845 of 2025(3) dt.24-11-2025 2/2 petitioner transpired during course of investigation. The only material, which has come in paragraph 53 of the case diary, that he is associate of co-accused Vishal Tiwary, with whom, the deceased had enmity. At best, petitioner is alleged to be conspirator. There is no eye-witness to the alleged occurrence. Similarly situated other co-accused Raja Dubey has already been granted the privilege of anticipatory bail by this Court vide order dated 14.10.2025 passed in Cr. Misc. No. 49098 of 2025. Petitioner is in custody since 06.02.2025. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Buxar in connection with Buxar (Town) P. S. Case No. 694 of 2024.
