2. The petitioner seeks bail in connection with Kahalgaon (Rasalpur) P.S. Case No. 87 of 2013 dated 03.03.2013 instituted for the offence under Section 395 of the Indian Penal Code.

3. The implication of the petitioner in the present case is on the basis of confessional statement of one Gopal Mahto, who is on inimical terms with the petitioner. He has till date not been put on test identification parade.

4. Co-accused Gopal Mahto @ Gopal Kumar

Patna High Court CR. MISC. No.70696 of 2024(2) dt.04-10-2024 2/2 and another co-accused persons, viz., Tiddha Mahto have been granted bail by a co-ordinate Bench of this Court as well as by this court.

5. Regard being had to the aforesaid facts as also the period of custody which is from 01.04.2024, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-XV, Bhagalpur in connection with Kahalgaon (Rasalpur) P.S. Case No. 87 of 2013.
