2. The petitioner seeks regular bail in connection with Sessions Trial No. 252 of 2025, arising out of Sirisiya P.S. Case No. 80 of 2024, lodged on 01.10.2024, under Sections 103(1) & 238(1) of the Bharatiya Nyaya Sanhita, 2023.
3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 06.08.2025, passed in Cr. Misc. No. 36336 of 2025, in which this Court had specifically inquired whether the charge had been framed or not. Upon being informed that the charge had not been framed, this Court was not inclined to grant bail to the petitioner, and his bail was accordingly refused.

Counsel further submits that it is admitted that a burnt body was recovered and to confirm whether the deceased is the particular person, a blood sample and DNA matching test are required in this case. Whereupon, a specific direction was given to the Investigating Officer in this regard, but even after obtaining permission, the test has not yet been completed. Counsel further submits that, according to him, there remains doubt as to whether the burnt body belongs to the same person in connection with whose murder this criminal case is pending. He submits that the petitioner is in custody solely on the basis of suspicion. Counsel further submits that the petitioner shall not abscond and undertakes to abide by any conditions imposed by this Court.
5. Learned APP for the State opposes the prayer for bail and submits that a report regarding present stage of the trial was called for.
6. It transpires to this Court that the charge has already been framed on 12.08.2025
7. In the present facts and circumstances of this case, and in view of the submissions made above as well as considering the fact that there remains doubt regarding the identity of the deceased, let the petitioner above named, be
