JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 306/34 of the Indian Penal Code.

Petitioner is the husband of the informant's daughter (the deceased). As per the prosecution case, parents of the petitioner used to torture and assault the deceased, due to which deceased and the petitioner started living separately. In the meantime, petitioner went to some other town to earn the livelihood. After few days, informant got information that his daughter committed suicide.

Learned counsel for the petitioner submits that the petitioner has been implicated in this case only because he happens to be the husband of the deceased. Moreover, from the narration of the FIR it is evident that petitioner was staying in

No.67044 of 2022(2) dt.04-04-2023 2/2 some other town at the time of incident and he was not even named in the FIR rather his name was added later on by police during investigation. Petitioner claims clean antecedent. Learned counsel for the State opposes the prayer for bail and submits that this is a case of committing suicide by the deceased within a year of marriage and the petitioner is her husband.

Considering the nature and gravity of the allegation and the fact that the petitioner is the husband of the victim who committed suicide within a year of marriage in suspicious condition at her matrimonial home, his prayer for bail is refused. (Prabhat Kumar Singh, J) Shashi U T
