The petitioner seeks bail in connection with Kundwa Chainpur P.S. Case No.5 of 2018 registered under Sections 272 and 273/34 of the Indian Penal Code besides Sections 30(a) and 37(B) of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 46 bottles, each containing 300 ml. Nepali Saufi Liquor, from the hut, situated in front of the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner having no criminal antecedent is in custody since 15.01.2018.

Having regard to the facts and the circumstances of the

Patna High Court Cr.Misc. No.16730 of 2018(2) dt.29-03-2018 2/2 case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 7th Additional Sessions Judge-cum-Special Judge, East Champaran at Motihari, in connection with Kundwa Chainpur P.S. Case No.5 of 2018.
