====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 341, 323, 354(B), 302, 504, 506 and other allied sections of the Indian Penal Code. As per prosecution case, all the F.I.R. named accused persons including this petitioner assaulted father of the informant by means of iron rod, Farsa, Dabia, Lathi and Danda and when the informant and his other family members came to rescue his father, they were also assaulted and during course of treatment, father of the informant succumbed to injuries. Learned counsel appearing for the petitioner submits that specific allegation of assault is against co-accused Sitaram Paswan, Shankar Paswan and Kamini Devi. So far this
Patna High Court CR. MISC. No.4784 of 2023(3) dt.17-04-2023 2/2 petitioner is concerned, there is no specific accusation of assault. He is simply named in the F.I.R. Moreover, from perusal of the F.I.R. it is apparent that counter case was also filed by coaccused Sitaram Paswan being Complaint Case No. 960 of 2022 on 24.05.2022.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Bhargama P. S. Case No. 103 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
