Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 212, 384, 386, 401, 427, 435 of the Indian Penal Code and 17 of C.L.A.Act.
Submission is that the FIR would reveal that the petitioner is not perpetrator of the crime rather some of the criminals were relatives of the petitioner and had taken meal with the petitioner. The petitioner has stated on oath that he has got no criminal antecedent. Petitioner is in custody since 03.02.2018.
Considering the aforesaid fact that there is no substantial material against the petitioner, let the petitioner,
Patna High Court Cr.Misc. No.18956 of 2018 (2) dt.04-04-2018 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barachatti Police Station Case No.92 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
