The petitioner, who is in custody, seeks bail in connection with Simultalla P.S. Case No. 49 of 2005 registered for the offence punishable under Section 386/34 of the Indian Penal Code.
It is alleged in the written report that 5-6 persons including the petitioner have looted the informant while he was working in Railway.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against the petitioner. He has falsely been implicated in this case. He has no criminal antecedent. Similarly situated two co-accused persons have
Patna High Court Cr.Misc. No.16268 of 2018 (3) dt.13-04-2018 2/2 already been granted bail by another co-ordinate Bench of this Court in Criminal Miscellaneous No. 21384 of 2013 and another analogous case.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Simultalla P.S. Case No. 49 of 2005.
