The petitioner seeks bail in connection with Excise Case No.1884 of 2018, arising out of Kudra P.S. Case No.310 of 2017, registered under Section 30(a) of the Bihar Prohibition of Excise Act, 2016.
The accusation is of recovery of 21 bottles, each containing 750 ml. Indian Made Foreign Liquor, and 44 bottles, each containing 200 ml. Country made liquor, from the house of the petitioner.
Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot at the time of raid of the house from where the alleged recovery is said to be made
Patna High Court Cr.Misc. No.16760 of 2018(2) dt.29-03-2018 2/2 and the said house is joint house of the petitioner. The petitioner, in the present case, is in custody since 18.01.2018. While the petitioner is accused in one another case, as detailed in paragraph-3 to this application, but he is on bail in that case. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge-cum-Additional Sessions Judge-IV, Kaimur at Bhabua, in connection with Excise Case No.1884 of 2018, arising out of Kudra P.S. Case No.310 of 2017.
