The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, both petitioners assaulted the informant on his leg, as a result of which leg of the informant got fractured.

It is submitted on behalf of petitioners that both parties are Gotia. Case and counter case. On account of land dispute the alleged occurrence took place. Moreover, there is inordinate delay in lodging of FIR.

Counsel for informant vehemently opposed the prayer

Patna High Court CR. MISC. No.67544 of 2022(2) dt.20-03-2023 2/2 for bail and submitted that both petitioners caused grievous injury on the leg of informant, as a result of which leg of the informant got fractured.

Considering the facts aforesaid and nature of injury, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
