The petitioner is languishing in custody since 13.08.2019 in a case registered for the offences punishable under Sections 341, 323 and 427 of the IPC and Sections 37(i)(ii) of the Bihar Prohibition and Excise Act, 2016.

It is alleged against the petitioner that he, in inebriated condition assaulted his children and widow mother. During death analyser test, it was found that the petitioner was in intoxicated condition.

It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.62572 of 2019(2) dt.25-10-2019 2/2 Learned APP submits that the petitioner is named in the FIR with specific accusation.

Considering the nature of accusation and the period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Rupaspur P.S. Case No. 368 of 2019.
