JUSTICE ARUN KUMAR ORAL ORDER 28-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Barhara (Krishnagarh) PS Case No. 199 of 2017 registered under Sections 399, 402 of the IPC and Sections 25(1-b), 26 and 35 of the Arms Act.
The allegation in brief is that the accused persons were found moving in a Scorpio vehicle and some arms were recovered, one of them disclosed that the petitioner is gang leader and at the time of occurrence he was in judicial custody.
Learned Counsel for the petitioner submits that there is no any material against the petitioner except disclosure of his name by the apprehended accused, at the time of alleged occurrence petitioner was in judicial custody and there is no any evidence to show that he was talking with the apprehended accused on mobile or giving any direction, investigation is complete and the petitioner is in custody in this case since 18.7.2017.
Having considered the said facts and circumstances, the petitioner, namely, Nityanand Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhojpur at
Patna High Court Cr.Misc. No.12491 of 2018 (2) dt.28-02-2018 Ara in connection with Barhara (Krishnagarh) PS Case No. 199 of 2017.
The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
