The petitioner seeks bail in Dulhin Bazar P.S. Case No. 190 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

One country made musket rifle is said to have been recovered from the bed room of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. The house from where the arm is said to have been recovered is the joint house where other family members are also residing. The petitioner has been languishing in custody since 09.08.2017.

Patna High Court Cr.Misc. No.53641 of 2017 (2) dt.09-11-2017 2/2 In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Prayer for bail of the petitioner is rejected.

However, the petitioner may renew his prayer for bail after four months or framing of charge whichever happens earlier.
