2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 109(1), 126(2), 115(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and sections 25(1-B)(a), 26 and 35 of the Arms Act.

3. As per prosecution case, on 6.7.2025 at about 10 pm petitioner was sleeping on the roof. In the meanwhile, when he woke up, he saw this petitioner and his two associates, all named in the FIR, standing close to his building. It is alleged that petitioner fired shots from his pistol on the informant but the same did not hit him. On raising alarm, people rushed to the spot and snatched pistol from the petitioner and handed over the same to the police. However, all the accused persons managed to escape.

4. It is submitted on behalf of the petitioner that this

Patna High Court CR. MISC. No.68795 of 2025(2) dt.07-10-2025 2/2 petitioner is innocent and has falsely been implicated in this case due to ulterior motive since petitioner is neighbour of informant. Though there is allegation of firing against the petitioner but no body sustained fire arms injury. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for pre-arrest bail.

6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Singhaul Police Station Case No. 117 of 2025, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
