JUSTICE ARUN KUMAR ORAL ORDER 25-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bibhutipur PS Case No. 244 of 2017 registered under Sections 30(A) and 40 of the Bihar Prohibition and Excise Act.

The allegation in brief is that 60 bottles Royal Stag foreign liquor total 45 litres was recovered from the cattle feed shed of the petitioner.

Learned Counsel for the petitioner submits that the petitioner had no knowledge about keeping of foreign liquor there which is accessable to anybody, the petitioner is in custody since 7.11.2017, and except a case of smaller recovery there is no other antecedent against the petitioner.

Having considered the said facts and circumstances, the petitioner, namely, Sanjeet Kumar @ Kari Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VI-cum- Special Judge (Excise) Samastipur in connection with Bibhutipur PS Case No. 244 of 2017.
