JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Chandauti PS Case No. 124 of 2017 registered under Section 30A of the Bihar Prohibition and Excise Act.
The allegation in brief is that 240 litres of country made liquor was being carried in a pick-up van and on seeing the police the persons boarding the pick-up van escaped away. Learned Counsel for the petitioner submits that the local chaukidar has disclosed name of the petitioner including others who are said to have escaped, except that there is no other material, the petitioner is in custody since 23.12.2017 and has got clean antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Raju Chaudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Gaya in connection with Chandauti PS Case No. 124 of 2017.
