1. Heard learned counsel for the parties concerned.

2. The petitioner was appointed as regular Assistant Teacher (untrained) on 12.09.2024, since then he has been working as Assistant Teacher (untrained) and at present he is posted at Government Upgraded Middle School, Tumkadiya, Bairiya, West Champaran.

3. The petitioner fell seriously ill and was unable to discharge his official duties. Consequently, he proceeded on medical leave on 08.07.2024. Thereafter, on

Patna High Court CWJC No.15163 of 2024(4) dt.04-08-2025 2/2 09.09.2024, the petitioner submitted an application before Respondent No. 3-Director, Primary Education, Bihar, Patna, seeking voluntary retirement in accordance with the applicable service rules. Despite the petitioner fulfilling all the eligibility criteria for voluntary retirement as prescribed under the relevant service conditions, his application/representation, dated 09.09.2024, annexed at Annexure-P/2, is still pending.

4. Learned counsel for the State submits that Director, Primary Education, Bihar, Patna, may be directed to dispose the representation of the petitioner in accordance with law.

5. Having consider the nature of prayer and the fact that representation of the petitioner is still pending, the Director, Primary Education, Bihar, Patna, is directed to dispose the representation within a period of four weeks in accordance with law.

6. With the aforesaid observation and direction, this writ application is, accordingly, disposed.
