The petitioner seeks bail in connection with Excise Case No. 919 of 2017 arising out of Ghosi P.S. Case No. 192 of 2017 registered under Sections 420, 467, 468, 471, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
1179 liters of country made liquor is said to have been recovered from the pick-up van and petitioner was apprehended guarding the said van, who disclosed that five accused persons managed to escape who are involved in selling of the liquor.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.20571 of 2018 (2) dt.16-04-2018 2/2 that no incriminating article has been recovered from conscious physical possession of the petitioner. Petitioner has no concern with the seized liquor. He has been falsely implicated in the case at the instance of his enemies by planting aforesaid recovery from his possession. He has no criminal antecedent. Similarly situated co-accused has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 15.09.2017 passed in Cri. Misc. No. 44180 of 2017. He has been languishing in custody since 05.03.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Jehanabad in connection with Excise Case No. 919 of 2017 arising out of Ghosi P.S.
