Petitioner has prayed for the following relief(s):- " 1. That this is an application for sauciness of an appropriate writ or direction commanding the respondents to release the amount deposited in Khata No. 485010110005428 Bank of India, Darbhaga, Laheriasarai with interest which has been kept held up to be released by the respondents on account of petition file by one Rabindra Thakur

Patna High Court CWJC No.23013 of 2019 dt.31-01-2023 2/2 and another Shailendra Kumar Pandey illegally, arbitrarily."

After some argument, learned counsel for the petitioner seeks permission to withdraw this petition reserving liberty to the writ petitioner to take recourse to such remedies as are otherwise available in accordance with law. As and when any such process is initiated, the same shall be decided expeditiously within a period of three months.

However, it is made clear that this Court has not expressed any opinion on the merits of the case and all issues of facts and law are left open.

The petition stands disposed of as withdrawn with the liberty aforesaid.
