2. The petitioner seeks bail in connection with Barachatti P.S. Case No. 686 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, petitioner is the driver of the vehicle in question from which recovery of 3528 liters of illicit liquor has been made.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner claims clean antecedent and he is in custody since 20.07.2023.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.71301 of 2023(2) dt.07-11-2023 2/2 prayer for bail.

6. Considering the allegations levelled against the petitioner, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail after framing of charge and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 2, Gaya, in connection with Barachatti P.S. Case No. 686 of 2023.
