JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner is seeking regular bail in Ghoghardiha P.S. Case No. 117 of 2017 (G.R. No. 1688/2017) registered for the offence under Sections 379, 414/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been implicated in the present case on the basis of confessional statement of the co-accused. It is further alleged that one motorcycle was recovered from the house of the petitioner, however, there is no material to connect that this petitioner had stolen the motorcycle in question or it was recovered from his conscious possession. Learned counsel submits that this petitioner has no criminal antecedent.

Learned A.P.P. for the State is present.

No.4800 of 2018 (2) dt.02-02-2018 2/2 Considering the facts and circumstances, particularly that the petitioner has no criminal antecedent, let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jhanjharpur, District - Madhubani in connection with Ghoghardiha P.S. Case No. 117 of 2017 (G.R. No. 1688/2017), subject to the conditions as laid down under Section 437(3) Cr.P.C. and that in case he is found involved in similar kind of offence again the Investigating Officer will have liberty to move for cancellation of bail of the petitioner.
