JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2019 This application, for grant of anticipatory bail, arises out of Ghoshi P.S. Case No. 211 of 2019, disclosing offences under Sections 363 and 365 of the Indian Penal Code. Prosecution case is that wife of the informant and his daughter has fled away with one Jay Prakash and informant suspected that said Jay Prakash and the petitioner kidnapped his wife and daughter.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and from the F.I.R. itself, it is evident that the wife of informant fled away with the co-accused Jay Parakash Learned counsel for the State and learned counsel for the informant opposed the prayer for anticipatory bail on the ground that the victim lady has named this petitioner also in her

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jehanabad, in connection with Ghoshi P.S. Case No. 211 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
