Grievance of the petitioner in the present writ application is discrimination in the matter of grant of promotion. Learned counsel for the petitioner submits that after judgment of full Bench in the case of Ram Nath Prasad Singh 2009(3) PLJR 384 the respondents have prepared final gradation list but respondents have made pick and choose, ignoring the seniority of the petitioner that juniors have been granted the benefit of B.A. trained scale.

Considering the aforesaid, the writ petition is disposed

Patna High Court CWJC No.20394 of 2019(2) dt.14-10-2019 2/2 of with a direction to the respondent District Programme Officer (Establishment), Saran at Chapra to examine the claim of the petitioner and if juniors have been granted the benefit of regular graduate trained scale then the respondents are under obligation to ensure grant of graduate trained scale to this petitioner from the date juniors of the petitioner have been granted such benefit with all consequential benefits within a maximum period of sixty days from the date of receipt/production of a copy of this order.

With the aforesaid, the writ application stands disposed of.
