The petitioner seeks pre-arrest bail in connection with Bansi P.S. Case No. 33 of 2017 registered under Sections 366, 366A, 368 read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that from perusal of the first information report itself, it would be evident that the allegation of abducting the daughter of the informant is confined against one Guddu Kumar and name of the petitioner has been given merely on suspicion as he was seen together with said Guddu Kumar. He submitted that
Patna High Court Cr.Misc. No.5750 of 2018 (2) dt.09-02-2018 the implication of the petitioner is an afterthought, as the first information report was instituted after four days of the alleged incident and there is no reasonable explanation for the delay caused in institution of the first information report. Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. He submitted that the informant has reasonable suspicion against the petitioner also that he may be involved in abduction of the daughter of the informant.
Regard being had to the nature of allegation, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Arwal in connection with Bansi P.S. Case No.33 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
