Petitioner, already in custody, seeks bail in connection with Barh P.S. Case No.232 of 2014 registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that while the deceased was returning back to home then on the way on the exhortation given by the petitioner, two other co-accused Kaushal Yadav and Rabo Yadav shot at the deceased causing his death. Learned counsel for the petitioner submits that the informant is not the eye witness, however the specific allegation of shooting on the deceased is against two other co-accused Rabo Yadav and Kaushal Yadav and the petitioner has no

Having considered the aforesaid facts and circumstances especially there is no allegation against the petitioner regarding shooting at the deceased, petitioner Arun Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Barh, Patna in connection with Barh P.S.
