Petitioners seek bail in Mansahi P.S. Case No.33 of 2019 registered under Sections 302, 120B and 34 of the IPC. The informant disclosed that Soni Devi (wife of his

Patna High Court CR. MISC. No.77868 of 2019(3) dt.17-03-2020 2/3 own brother Pankaj Kumar) informed him that Pankaj Kumar died. On such information, the informant along with other family members went to the house of in-laws of his own brother and found the dead body of his brother Pankaj Kumar. It is alleged that his brother Pankaj Kuamr was strangulated to death by his wife, brother-in-law, father-in-law and mother-in-law. Learned counsel for the petitioners submits that the petitioners are brother-in-law, wife, father-in-law and mother-inlaw of deceased. The deceased of course died inside the house of the petitioners but the deceased was under deep depression and he himself committed suicide. Nobody assaulted the deceased but it appears from perusal of the F.I.R.

and the case diary that the deceased was found dead inside the house of the petitioners. There was mark of strangulation and a rope was also found tied around the neck of the deceased. It has come that the deceased was recently married with Soni Devi but Soni Devi and her family members did not like the deceased to stay in their house. The deceased went to see his wife and thereafter his wife and others are alleged to have killed Pankaj Kumar by strangulating him.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioners on bail. Accordingly, the same

Patna High Court CR. MISC. No.77868 of 2019(3) dt.17-03-2020 3/3 is dismissed.

The trial court is directed to hold the trial on day to day basis and conclude the same within one year after commitment of the case.
