====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 29-01-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Akilpur P.S. Case No.46 of 2021, registered for the offences punishable under Sections 341, 323, 363, 365/34 of the Indian Penal Code but later on Section 376/420 of the Indian Penal Code also added.

3. As per the prosecution case, informant has alleged that his father-in-law, mother-in-law and Shali have handed over his wife and children to some one for money.

4. Learned counsel for the petitioner submits that the petitioner is not named accused in this case, however, after statement of the victim under Section 164 of Cr.P.C., the petitioner has been implicated in this case. He further submits

No.70640 of 2023(4) dt.29-01-2024 2/2 that the victim on her sweet will started residing with the petitioner and now they have solemnized marriage and residing as husband and wife and in this regard the victim has filed a petition before the Court below. He also submits that petitioner has no criminal antecedent, he is in jail since 14.05.2023 and charge sheet against the petitioner has already been submitted after investigation.

5. Learned counsel for the victim and learned APP for the State concealed this fact and submits that they have no objection if the petitioner may be granted bail in this case.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Chapra, District Saran in connection with Akilpur P.S. Case No.46 of 2021.
