Earlier the prayer for bail of the petitioners was rejected by this Court, vide order dated 4.7.2017 passed in Cr. Misc. No.20413 of 2017 with a direction to the learned trial court to conclude the trial within a period of six months. Submission of the learned counsel for the petitioners is that the period of six months has already expired and up-tillnow only two witnesses have been examined and furthermore there is no specific allegation against the petitioners and there is general and omnibus allegation against them. They are in custody since 13.9.2016.
Heard learned A.P.P. and the learned counsel for the informant.
Patna High Court Cr.Misc. No.11524 of 2018 (2) dt.07-03-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II, Danapur, Patna in connection with Sessions Trial No.387 of 2017 arising out of Bihta P.S.Case No.665 of 2016 with condition that they will cooperate in disposal of the trial and will also appear as and when required by the learned court below; otherwise their bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
